What North Dakota Gun Owners Need to Know
A major federal NFA injunction is now in effect—but North Dakota has a separate state law that cannot be ignored.

Mattson Munitions will continue following the established NFA process unless and until we receive approval or clear official guidance from ATF permitting us to do otherwise.
North Dakota Is Different
The recent federal court injunction is a major development for suppressors and certain other NFA firearms. However, North Dakota remains in a unique position because our state has its own law requiring compliance with the National Firearms Act.
North Dakota Century Code § 62.1-05-01
North Dakota law states that a person may not purchase, sell, have, or possess a silencer—or certain other listed weapons—unless that person has complied with the National Firearms Act, 26 U.S.C. §§ 5801–5872.
What Does This Mean Right Now?
The federal injunction does not necessarily remove North Dakota’s separate state-law requirement. Until the relationship between the court order and North Dakota law is officially clarified, gun owners should not assume that suppressors may be purchased, transferred, or possessed without the traditional NFA process.

The Injunction Is Limited
The judgment protects the specified plaintiffs and, where applicable, their members, customers, agencies, and political subdivisions. It did not repeal the entire NFA nationwide.

North Dakota Law Still Matters
North Dakota’s statute independently refers to NFA compliance, creating an important state-law issue for suppressor owners, buyers, and dealers.
03 — Mattson Munitions Policy
No Immediate Changes
Mattson Munitions will maintain its current paperwork, ATF-approval, background-check, waiting-period, and transfer procedures unless ATF authorizes a change.
What Customers Should Do
Customers with pending applications do not need to take any action at this time. Do not cancel or withdraw an application based solely on headlines or social-media posts.
We are monitoring the court proceedings, ATF communications, and North Dakota law. If confirmed guidance changes how we may legally process a transfer, we will explain what changed and what customers need to do next.
The Bottom Line
Nothing changes at Mattson Munitions without ATF approval or clear official guidance. Until then, we will continue processing all regulated items under the established NFA requirements.
